Consequences for Suing the Military?
Are There Consequences if I Sue the Military?
No Consequences for Suing the Military
No, there are no consequences if you sue the military! Your military benefits and entitlements, or those of your family will not be threatened simply because you file a claim or sue the military for injuries you or your loved ones suffered. You have a statutory right to seek compensation for acts of the military that fall below their required standard of care. Even if you lose, there is no meaningful risk that you are in jeopardy of losing money or benefits.
Retaliation is not an acceptable response by the Government. In fact, in most situations, a lawsuit will be handled by lawyers in Washington D.C. or at certain regional service centers. Under many circumstances the immediate chain of command will not even know that a lawsuit is pending.
Consequences of Filing a Lawsuit Against the Military
The military handles claims and lawsuits in their normal course of business. Filing a lawsuit is extremely stressful for our clients because it’s the first time they’ve ever been through something like this. Often they are dealing with both the stress of the injury itself and the concern for how the lawsuit will turn out. On the other hand, the military sees these types of actions daily. In fact, they have entire offices filled with dozens of young lawyers to deal with these types of cases. There aren’t military leaders that are going to become irate and lash out against you – it will simply be a matter of professional determination of whether they will quickly settle the matter or elongate it to get a decision from a judge or jury.
Too often, those entitled to compensation from the military for wrongs and injuries they suffered go unfiled because of the fear of reprisal. In our years of experience dealing with military claims, lawsuits, and other legal actions, we have yet to see any consequence suffered by our clients in the nature of reprisal or retaliation for filing a claim for an injury suffered at the hands of the military. We focus our legal efforts on not only ensuring the most appropriate compensation for your injuries but also ensuring you are not negatively impacted by the decision to file a claim or lawsuit in the first place.
